外国人留学生の就職先を拡大するための制度、新たに入管法の告示改正が行われ「特定活動」46号が2019年5月30日に公布されました。
日本の大学や大学院で勉強した外国人留学生が、卒業、修了後の就職で、より幅広い職種の選択肢が増えました。

日本に在留する外国人留学生の就職がかなり変わったこの新しい制度について、詳しくご説明いたします。

この特定活動46号は、「外国人留学生の就職支援」が主な目的です。
就職先の業務内容の中に、日本語を使う業務が含まれるなどの要件を満たしていれば「飲食・宿泊・製造業の現場で働ける」ようになりました。
これまで飲食・宿泊・小売等のサービス業や製造業などは、一般的な「技術・人文知識・国際業務」の対象外でした。そのため日本で大学や大学院を卒業しても、これらの業種で働くことはできませんでした。
この制度により、一定の条件を満たした留学生を対象に特定活動ビザを与えることによって、サービス業や製造業での仕事が可能になりました。

〇要件となるガイドライン

■　対象となる求職者

1. 常勤の従業員として雇用され日本の大学又は大学院において修得した知識や能力等を活用することが見込まれる。

2. 日本の大学を卒業、または大学院の課程を修了し、学位を授与されている。
(※短期大学、専門学校、外国の大学・大学院の卒業者及び修了者は対象外)

3. 日本人と同額以上の報酬を受ける。

4. 高い日本語能力を有している。日本語能力試験　N1 or BJT 480点以上

5. 転職した場合は、在留資格変更許可申請が必要。

6. 家族の滞在が可能。配偶者又は子については「特定活動」（本邦大学卒業者の配偶者等）の在留資格で、日常的な活動が認められる。

■ 対象となる業務内容

業務に日本語を使う業種であること。
自らの作業を行うだけの受動的業務では足りず、自ら第三者へ働きかける双方向のコミュニケーションを要する業務であること。（それに併せて、一般的なサービス業務や製造業務等を行うことが可能。）

正社員、契約社員
滞在制限期間/就労制限　なし・更新可能。一部単純労働も可
